These Terms are an agreement between you and Racoza Studios, LLC covering the online services behind Rubber Ducks! — your account, the leaderboards, friends, and anything you buy in the game. By playing, you agree to them. If you do not agree, please do not use the App.
Rubber Ducks! (the “App”) is downloaded from the Apple App Store or Google Play, and we run online services behind it — saved progress, leaderboards, friends, purchases and moderation (together, the “Services”). These Terms govern the Services.
Your licence to use the App software itself is separate. On iOS, that licence is Apple’s standard Licensed Application End User License Agreement, which applies automatically when you download the App. On Android, it is the licence granted under Google Play’s terms. We are not replacing either of those here. Where they conflict with these Terms on the subject of the software licence, they win.
Apple and Google are not parties to these Terms and are not responsible for the App or the Services. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any questions, complaints or claims about the App or the Services should come to us, not to them.
Rubber Ducks! is a general-audience game intended for players aged 13 and over. It is not directed to children under 13, and you may not use the Services if you are under 13. If you are between 13 and the age of majority where you live, you should read these Terms with a parent or guardian.
If we learn that an account belongs to someone under 13, we will delete it and the data attached to it, as described in our Privacy Policy.
The first time you open the App we create an anonymous account for you automatically. You do not have to give us anything to play. You may optionally sign in with Apple or Google, which links your progress to an account you can restore on another device.
Our Community Guidelines are part of these Terms and explain what is and is not acceptable, particularly for display names. In addition, you agree not to:
We may, at our discretion and where we reasonably believe these Terms or the Community Guidelines have been broken:
Where the situation allows, we will act proportionately and start with the smallest step. If you think we have got it wrong, email support@racoza.com and a person will look at it. If we terminate an account for breaking these Terms, purchases attached to it are not refunded.
The App sells gem packs, an ad-free upgrade, and a 30-day VIP boost. All payments are processed by Apple or Google, not by us. We never see your payment details.
Gems, coins, eggs, skins and similar items are virtual items. When you buy them you receive a limited, personal, non-transferable licence to use them inside Rubber Ducks!. You do not own them. They:
VIP is a one-time 30-day purchase, not a subscription. It does not auto-renew, you will not be billed again, and there is nothing to cancel. If you buy it again while it is still active, the time is added to what you have left.
The ad-free upgrade can be restored on a new device using the “Restore purchases” option in the App, through your Apple or Google account. Consumable purchases such as gem packs are spent when used and cannot be restored once consumed.
Refunds work differently on each platform, and on iOS they are genuinely out of our hands.
If a purchase is refunded, we may remove what it granted — including gems, the ad-free upgrade or VIP time. If gems were already spent and the balance is short, the shortfall may be carried against future purchases. Repeatedly buying and refunding may result in the loss of access to purchases.
We may change prices, pack sizes and what is available for sale. Changes apply to future purchases, never retroactively to something you have already bought. Occasionally a sale price is offered for a limited time.
Rubber Ducks! is free to play and funded by advertising. The App shows banner, interstitial and rewarded ads. Rewarded ads are always optional — you choose to watch one in exchange for an in-game reward, and nothing is taken away if you do not. Buying the ad-free upgrade removes banner and interstitial ads. How we handle advertising data, and how to change your advertising choices, is set out in our Privacy Policy.
Rubber Ducks! is a live game. We add, change and remove features, game modes, events and content, and we may reset or reorganise leaderboards. We may also suspend the Services for maintenance, or stop offering them altogether. If we ever shut the Services down permanently, we will give reasonable notice in the App where we can.
We do not promise the Services will always be available, uninterrupted or error-free.
The App, its artwork, ducks, sounds, code and name belong to Racoza Studios, LLC or our licensors. You may not copy, distribute or make derivative works from them except as the App itself allows.
The only content you create is your display name and the challenge images the game generates from your board. By using them you give us permission to display and store them as part of running the Services — for example, showing your name on a public leaderboard or in a challenge link preview. You keep whatever rights you had in them.
The Services are provided “as is”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, Racoza Studios, LLC is not liable for indirect, incidental or consequential losses, or for lost progress, scores or virtual items. Where we are liable, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or US $50.
Nothing in these Terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the rights your local consumer law gives you, and where that law conflicts with this section, it wins.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and the courts of Florida will have jurisdiction. If you are a consumer resident in the EEA, the UK, or another place whose law guarantees you the protection of your local courts and consumer law, this section does not deprive you of that protection.
We may update these Terms. When we do, we will change the “Last updated” date above, and for material changes we will tell you in the App before they take effect. Continuing to play after that means you accept the updated Terms.
